We accept commercial claims on a
contingent fee basis. In some cases where a lawsuit is necessary to
collect, depending upon the degree of collectibility of the claim, a nominal
suit
fee may be required.
A "commission" is a
contingent fee. Commissions are due and payable when a recovery is made.
Commissions compensate for the work performed and the success of recovery.
Commissions take into consideration the amount involved and the results
obtained. A contingent fee involves risk and uncertainty apart from the amount
of work performed. Commissions may be withheld from a recovery.
The commission rate may be the
"CLLA rate" or it may be negotiated. When evaluating the
commission rate we consider the degree of collectibility of the claim. We
consider such factors as:

What is the size of the claim;

How old is the claim;

What is the reason for
non-payment;
-
What is the basis of the claim
(open account, written contract, etc.);

Where is the debtor located;
-
What is the debtor's composition
(individual, corporation, LLC, etc.).
Claims based upon non-sufficient
funds ("NSF") checks are also accepted, usually regardless of the
amount of the check.
We have represented creditors in
a wide variety of commercial matters including the sale of goods, insurance
premium matters, transportation, student loan, credit union claims, bank loans,
credit card claims, mortgage foreclosures, repossessions and deficiency matters.
